A First Class Magistrate, upon being satisfied that neglect or refusal has occurred, may direct the person responsible to pay a monthly maintenance amount deemed reasonable. The amount is payable directly to the eligible dependent.
In cases involving a minor girl child, if the husband lacks sufficient means, the Magistrate may order the father to pay maintenance until the child attains adulthood.
Interim Maintenance and Legal Expenses
While maintenance proceedings are ongoing, the Magistrate may also grant interim maintenance along with reasonable legal expenses to the wife, children, or parents. Such interim applications are generally expected to be decided within 60 days from the date of service of notice.
For clarity under this provision:
A minor refers to a person who has not attained majority under the Indian Majority Act, 1875.
The term wife includes a divorced woman who has not remarried.
Enforcement and Penalties for Non-Compliance
Maintenance or interim maintenance is usually payable from the date of the court order or, where applicable, from the date of application. If the ordered amount is not paid without valid justification, the Magistrate may issue a recovery warrant and impose imprisonment of up to one month for each instance of default, unless payment is made earlier.
However, recovery proceedings must be initiated within one year from the date the maintenance amount becomes due.
Exceptions and Cancellation of Maintenance Orders
If a husband offers maintenance on the condition that his wife resides with him, and she declines, the Magistrate may evaluate the reasons for refusal and pass an order if it is considered fair and justified.
Maintenance may be denied or cancelled if:
The wife is living in adultery
She refuses to live with her husband without sufficient cause
Both parties are living separately by mutual agreement
In such circumstances, the court has the authority to revoke an existing maintenance order.

Section 304B – Punishment for Dowry Death
When the death of a woman occurs due to burns, bodily injuries, or under unnatural circumstances within seven years of marriage, and evidence shows that she was subjected to cruelty or harassment by her husband or his relatives in connection with dowry demands shortly before her death, such a death is legally classified as a dowry death.
In such cases, the law presumes that the husband or the concerned relatives are responsible. The offence is punishable with imprisonment of not less than seven years, which may extend to life imprisonment.
Section 375 – Rape
A man is said to commit rape if he engages in any of the following acts with a woman:
Penetrates his penis, to any extent, into her vagina, mouth, urethra, or anus, or compels her to do so with him or another person;
Inserts any object or part of the body (other than the penis) into her vagina, urethra, or anus, or causes her to do so;
Manipulates any part of her body to cause penetration into her vagina, urethra, anus, or any other body part;
Applies his mouth to her vagina, anus, or urethra, or forces her to do so.
These acts amount to rape when committed under any of the following circumstances:
Against her will
Without her consent
With consent obtained through fear of death or bodily harm
With consent obtained by deception regarding identity or marital status
With consent given while the woman is intoxicated, mentally unsound, or unable to understand the consequences
With or without consent, when the woman is below 18 years of age
When the woman is incapable of communicating consent
Clarifications
The term vagina includes the labia majora.
Consent must be a clear, voluntary, and unequivocal agreement expressed through words or conduct.
Lack of physical resistance does not imply consent.
Exceptions
Medical procedures or interventions do not constitute rape.
Sexual intercourse by a man with his wife, provided she is not under fifteen years of age, is excluded from the offence.
Section 376A – Rape Resulting in Death or Vegetative State
If a person commits rape and causes injuries that result in the woman’s death or leave her in a persistent vegetative state, the punishment shall be rigorous imprisonment of at least twenty years, which may extend to imprisonment for the remainder of natural life, or death.
Section 376D – Gang Rape
When a woman is raped by one or more persons acting together or with a shared intention, each participant shall be held equally responsible. The punishment includes rigorous imprisonment of not less than twenty years, which may extend to life imprisonment, along with a fine.
Any fine imposed must be sufficient to cover the victim’s medical treatment and rehabilitation and shall be paid directly to the victim.
Section 498A – Cruelty by Husband or Relatives
Any husband or relative of a husband who subjects a woman to cruelty shall be punished with imprisonment up to three years and may also be fined.
Meaning of Cruelty
Cruelty under this section includes:
