Under the Employees’ State Insurance (ESI) Act, 1948, any business that meets the required employee limit in a particular state must obtain ESI registration. The act applies to the following types of establishments:

  • Cinema halls

  • Healthcare facilities

  • Hotels and restaurants

  • Newspaper agencies

  • Private schools and colleges

  • Roadside motor transport units

Note: Hotels and restaurants should be engaged only in service-related activities and not in manufacturing. In some states, medical and educational institutions are excluded from coverage, and newspaper establishments are not governed by the Factory Act.

Employee State Insurance (ESI) is a social security scheme introduced by the Government of India to offer employees medical care, financial support, and various other welfare benefits. The program is administered by the Employees’ State Insurance Corporation (ESIC), an independent organization operating under the Ministry of Labour and Employment.

In most states, businesses with 10 or more employees must register under ESI, while in some states, the requirement applies only when the workforce exceeds 20 employees.

Benefits of Online ESIC Registration

Registered ESI members and their families are entitled to comprehensive medical care and insurance coverage effective from the first day of employment.

Maternity benefits are available to pregnant women for up to twenty-six weeks. On medical recommendation, this time might be prolonged by 30 days. To qualify for maternity benefits, businesses must pay 70 days of earnings during the previous two contribution periods.

Employees with disabilities may be eligible to receive disability benefits of up to 90% of their average monthly wages.

Absence from work due to sickness is limited to 91 days per year and is compensated at 70% of the monthly income.

In the unfortunate event of the demise of an employee during the employment, the dependents of the deceased will receive 90% of his/her monthly salary.

The family of the deceased employee is entitled to an additional amount of ₹10,000 towards funeral expenses.

Under the ESI system, confinement expenses can be claimed if an insured woman or an employee’s wife is confined in a location with no medical services.

Permanently physically challenged, insured employees are entitled to undergo vocational rehabilitation training at VRS.

  • Employees earning a gross monthly salary of up to ₹21,000 are eligible for ESI coverage through their employer.

  • The business must be registered with the EPFO.

  • The total ESI contribution is 6.5% of the gross salary, split as:

    • Employer: 4.75%

    • Employee: 1.75%

  • In industrial units where employees are exposed to higher risks of injury or health hazards, all staff earning below ₹21,000 must mandatorily be covered under ESI.

  • Typically, a company must have 10 or more employees to register for ESI. In some regions, the threshold is more than 20 employees.
